SUMMARY & BACKGROUND:
This Ordinance authorizes the expenditure of $16,413 for the purchase of a replacement Cyanide Distilling Unit at Environmental Services. This critical and essential expenditure will replace equipment that is twenty (20) years old. In addition, this Cyanide Distilling Unit is essential and critical to complying with the Ohio EPA National Pollutant Discharge Elimination Systems (NPDES) permit for stormwater and federal, state and local regulations for the Pretreatment program. One formal bid response was received from Thomas Scientific, LLC. Thomas Scientific, LLC has been selected and has met the criteria according to the guidelines of the TMC Chapter 187. Sufficient funds have been provided in the DPU CIP replacement plans for Sewer, Water and Stormwater.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a purchase agreement for the purchase of a cyanide distilling unit, upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.
SECTION 2. That the expenditure in an amount not to exceed $16,413 is authorized from the Account Codes below for the purchase of a cyanide distilling unit.

SECTION 3. That the Finance Director is authorized to issue warrant or warrants in the amount not to exceed $16,413 from the account codes listed in Section 2 in payment of the above-authorized obligations upon presentation of proper voucher or vouchers.
SECTION 4. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for further reason that the Ordinance must be immediately effective in order to allow for the critical and essential replacement of the Cyanide Distilling Unit at Environmental Services.
