SUMMARY & BACKGROUND:
An amount of $50,000 has been allocated by the Toledo Lucas County Public Library to help fund an upgraded pedestrian crossing on Central Avenue for the Sanger Branch Library. Matching funds will be provided through the District Improvement Program funds and through the Division of Engineering and Construction Management Matches and Planning budget. This project is planned for construction in 2026.
Passage of this ordinance is required to enable the City of Toledo to accept outside funding for this project and have it in place to help pay for these expenditures.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into and execute cooperative agreements with and accept financial assistance from the Toledo Lucas County Public Library for the upgraded crossing on Central Avenue at the Sanger Branch Library upon such terms and conditions as shall be approved by the Director of Transportation and the Director of Law.
SECTION 2. That the Mayor is authorized to accept and deposit grant proceeds in the amount of $50,000 from the Toledo Lucas County Public Library into the Capital Improvement Fund Account Code 540G-35000-8GA8662STDSTD for the crossing upgrade project.
SECTION 3. That the appropriation of $50,000 is authorized from the grant proceeds of the Capital Improvement Fund into the Account Code listed in Section 2 for the project listed above; and authorizing expenditure of same.
SECTION 4. That the Mayor is authorized to prepare plans and specifications and to enter into contracts for the project including such items as labor, materials, construction testing, professional services, property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way. Contracts shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Director of Transportation and the Director of Law.
SECTION 5. That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 2 in an amount not to exceed $50,000 in payment of the obligations incurred pursuant to the contracts authorized in Section 4 upon presentation of the proper voucher or vouchers.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate the planning and construction of this project.
