RESPONSE:
On November 1, 2023, the Lucas County Court of Common Pleas granted the motions for summary judgment of the City and the Toledo-Lucas County Board of Health, finding the ordinance enforceable. The plaintiff appealed that decision to the Sixth District Court of Appeals. The matter has been fully briefed and is scheduled for oral arguments on May 14, 2024.
