Approving a Petition For Special Assessments for Special  
Energy Improvement Projects and a Project Plan for the  
Northwest Ohio Advanced Energy Improvement District under  
Chapter 1710 of the Ohio Revised Code for The Toledo  
Country Club and 3900 River Rd., Toledo, Ohio 43614; to  
authorize and levy special assessments for the purpose of  
acquiring, constructing, and improving certain public  
improvements in the City of Toledo in cooperation with the  
Northwest Ohio Advanced Energy Improvement District; and

DEPARTMENT OF LAW:  
Authorizing the settlement of the claims of Timothy  
Temple for the sum of $40,000 to be paid from the Risk  
Management Fund; and declaring an emergency.  
Approving the revision of the current Collective  
Bargaining Agreement between the Clerk of Toledo  
Municipal Court and UAW Local 12, for a successor  
agreement, consistent with the bargained  
understandings; and declaring an emergency.

COUNCILMEMBER KOMIVES PRESENTS THE FOLLOWING 8 ITEMS FROM  
THE DEPARTMENT OF TRANSPORTATION:  
Authorizing the appropriation and expenditure of an amount not  
to exceed $10,000,000 from the unappropriated balance of the  
Water Replacement Fund for the Water Main Program;  
authorizing the Mayor to prepare plans and specifications,  
acquire required rights-of-way and easements as appropriate,  
accept bids and enter into contracts after due advertising for the  
design and construction of water mains; and declaring an  
emergency.  
Authorizing the appropriation and expenditure of an amount not  
to exceed $7,200,000 from the unappropriated balance of the  
Sewer Replacement Fund for various sewer replacement and  
improvement projects; authorizing the Mayor to prepare  
engineering studies, plans and specifications, acquire  
rights-of-way and easements as necessary, accept bids and  
enter into contracts; and declaring an emergency.  
Authorizing the appropriation and expenditure of an  
amount not to exceed $3,240,000 from the  
unappropriated balance of the Storm Water Utility  
Improvement Fund for various drainage improvement

projects; authorizing the Mayor to prepare engineering  
studies, plans and specifications, acquire rights-of-way  
and easements as appropriate, accept bids and enter into  
contracts for said drainage improvement projects; and  
declaring an emergency.  
Authorizing the Mayor to enter into agreements with and accept  
and deposit financial assistance from the State of Ohio, Ohio  
Public Works Commission (OPWC) in an amount not to  
exceed $2,254,574 for four roadway projects; authorizing the  
appropriation and expenditure of said grant and loan proceeds  
for the subject projects; authorizing a dedicated source for  
repayment of said loans; authorizing the Mayor to accept bids  
and execute the necessary documentation for all contracts  
related to construction, professional services, contingencies,  
capitalized interest, testing, and permit fees; and declaring an  
emergency.  
Authorizing the Mayor to enter into cooperative grant  
agreements with and accept financial assistance from the  
State of Ohio Department of Transportation (ODOT)  
for design and construction projects; authorizing the  
acceptance, deposit, appropriation, and expenditure of  
grant proceeds into the Capital Improvement Fund in an  
amount not to exceed $13,116,458; authorizing the  
Mayor to accept bids and award contracts related to the  
design and construction; and declaring an emergency.  
Authorizing the appropriation and expenditure of an amount not  
to exceed $6,500,000 from the Capital Improvement Fund for  
the Roadway Matches & Planning Program; authorizing the  
Mayor to prepare plans and specifications, acquire required  
rights-of-way as appropriate, accept bids and enter into  
contracts for these projects within the Division of Engineering  
and Construction Management; and declaring an emergency.  
Authorizing the appropriation and expenditure of an amount not  
to exceed $36,000,000 from the Roadway Improvement Fund  
for the General Resurfacing Program; authorizing the Mayor  
to prepare plans and specifications, acquire required  
rights-of-way as appropriate, utilize professional services  
necessary for planning, design, project management, and  
construction inspection, and to accept bids and enter into

contracts for these projects within the Division of Engineering  
Services; and declaring an emergency.  
Authorizing the Mayor to enter into a three-year software  
license agreement with two three-year renewal options for the  
purchase of SWPPPTrackPro; authorizing the expenditure in  
an amount not to exceed $27,000 annually from the Storm  
Water Operating Fund; waiving the competitive bidding  
provisions of TMC Chapter 187; and declaring an emergency.  
COUNCILMEMBER KOMIVES PRESENTS THE FOLLOWING ITEM FROM THE  
DEPARTMENT OF PUBLIC SERVICE:  
Authorizing the expenditure of an amount not to exceed  
$24,000 from the General Fund for the investigation  
and site clean-up of the property located at 433 Baden  
Street; authorizing the Mayor to enter into contract with  
Klumm Brothers Company for the clean-up; and  
declaring an emergency.  
COUNCILMAN MARTINEZ PRESENTS THE FOLLOWING 3 ITEMS FROM THE  
DEPARTMENT OF PUBLIC UTILITIES:  
Authorizing the Mayor to enter into a contract with  
Hillabrand & Sons Construction for the emergency  
removal and replacement of three water main valves at  
the intersection of Arco Dr. & Frenchmens Rd;  
authorizing the expenditure of an amount not to exceed  
$80,000 from the Water Replacement Fund; waiving  
the formal competitive bidding provisions of TMC  
Chapter 187; and declaring an emergency.  
Authorizing the appropriation and expenditure of an amount  
not to exceed $431,954 from the Water Replacement  
Fund and an amount not to exceed $431,954 from the  
Sanitary Sewer Replacement Fund to provide as needed  
professional services necessary to continue program  
management duties related to the AMI Program, as well as  
associated miscellaneous coordination, billing, and data  
analysis; authorizing the Mayor to enter into contract for  
professional services; waiving the competitive bidding  
provisions of TMC Chapter 187 for said purpose; and  
declaring an emergency.

Authorizing the Mayor to execute an Amended Land and Right  
of Way License Agreement with Columbia Gas of Ohio, Inc. for  
certain land owned by the City of Toledo that is located in the  
Maumee Riverfront-Riverfront Northwest; authorizing the  
receipt and deposit of revenue income; and declaring an  
emergency.  
COUNCILWOMAN McPHERSON PRESENTS THE FOLLOWING ITEM FROM  
THE DEPARTMENT OF PARKS & YOUTH SERVICES:  
Authorizing the Mayor to accept a grant from  
NeighborWorks through the Cleveland Cliffs  
Foundation in the amount of $10,000 to support  
development of Pontiac Preserve, authorizing the  
deposit, appropriation and expenditure of $10,000 in the  
Capital Improvement Fund for the project and declaring  
an emergency.  
COUNCILWOMAN MORRIS PRESENTS THE FOLLOWING 3 ITEMS LIKELY TO  
BE RELIEVED OF ZONING & PLANNING COMMITTEE:  
Accepting the City Plan Commission’s recommendation  
for local landmark designation for the Building located at  
25 S. Superior Street, in accordance with Toledo  
Municipal Code Section 1111.1002; and declaring an  
emergency.  
Accepting the City Plan Commission’s recommendation  
for local landmark designation for the Building located at  
19 S. Superior Street, in accordance with Toledo
