The City of Toledo, the City of Oregon, the City of Maumee, the  
City of Northwood, the City of Perrysburg, the City Sylvania, the  
Village of Whitehouse, the Township of Monclova, the Township  
of Springfield, the Township of Swanton, the Township of  
Sylvania, the Township of Washington, the City of Napoleon, and  
the Toledo-Lucas County Port Authority have partnered to create  
an Energy Special Improvement District (“District”) under Ohio  
Revised Code Chapter 1710 and a non-profit corporation, known

as the Northwest Ohio Advanced Energy Improvement District  
(“Corporation”), to govern the District. Property owners within  
the District are permitted to make certain “energy efficiency  
improvements” to their properties, which constitute a “special  
energy improvement project”, and pay for the cost of the special  
energy improvement project by way of special assessments in  
accordance with the process set out in Chapters 727 and 1710 of  
the Ohio Revised Code. Revised Code Section 1710.01(G)  
provides that special energy improvement projects (including  
energy efficiency improvements) constitute public improvements  
and are therefore subject to special assessments.  
Metropolitan Park District of the Toledo Area (the “Petitioner”) is  
the owner of 100% of the property described on Exhibit A  
attached hereto (the “Property”). The Petitioner has caused the  
completion of an energy assessment of the Property.  
The energy assessment has identified energy conservation  
measures, all of which qualify as energy efficiency improvements  
as defined in Revised Code Section 1710.01(K), which Petitioner  
has determined to proceed with implementing in conjunction with  
financing to be secured by and repaid through special  
assessments.  
Petitioner has submitted to this Council the Petition for Special  
Assessments for Special Energy Improvement Projects (the  
“Petition”) seeking (i) the addition of certain of its property to the  
District and (ii) approval of an amendment to the District’s  
comprehensive plan for special energy improvement projects to  
include the Metropolitan Park District of the Toledo Area Special  
Energy Improvement Project (the “Special Energy Improvement  
Project”) and requesting that the Project be undertaken by the  
District and that the costs thereof be specially assessed against the  
Property specially benefited thereby.  
A complete list and description of the Special Energy  
Improvement Project is on file with the Clerk of Toledo City  
Council and is attached as Exhibit B to this Resolution. Exhibit  
B provides the following information for the Special Energy  
Improvement Project:  
1. Identification of the parcel number and name of the

Property/building to be improved;  
2. A description of the nature of the Special Energy  
Improvement Project for the particular parcel;  
3. The estimated amount of the special assessment to be  
levied against the Property (the “Special Assessment) and  
the number of years the Special Assessment will be  
collected (if not paid in cash within 30 days after the  
passage of the assessing ordinance as provided by law).  
The total dollar cost of the Special Energy Improvement  
Project, including accrued interest and the associated closing  
costs, is estimated to be Two Million Four Hundred Four  
Thousand Four Hundred Sixty Five and Thirty-Two Cents  
($2,404,465.32). Each semi-annual payment represents the  
payment of a portion of the principal of and interest, the program  
administration fee, and the Lucas County, Ohio special  
assessment collection fee due with respect to each semi-annual  
payment. The total amount to be assessed against the property  
pursuant to this Ordinance is Four Million One Hundred  
Twenty-Eight Thousand Two Hundred Fifty-Five and Forty Cents  
($4,128,255.40).  
The cost of the Project will be funded through a loan from  
the Toledo-Lucas County Port Authority’s Northwest Ohio Bond  
Fund. Ultimately, the loan will be repaid over time from the  
Special Assessments paid by Petitioner. Petitioner, in turn, is  
expected to be able to pay a portion of the Special Assessment  
from the energy savings estimated to be achieved as a result of the  
Special Energy Improvement Project.  
The annual Special Assessment for the Special Energy  
Improvement Project is to be paid in semi-annual payments over  
nineteen years. The plans and specifications for the Special  
Energy Improvement Project are on file with the Clerk of Council.  
The Petitioner also waives all further notices, hearings, claims for  
damages, rights to appeal and other rights of property owners  
under the law, including but not limited to those specified in the  
Ohio Constitution, Chapter 727 of the Revised Code, the Toledo  
City Charter and the Toledo Municipal Code. Petitioner consents  
to the immediate imposition of the Special Assessment upon the  
Property specially benefited by Special Energy Improvement  
Project.

This special assessment process is a voluntary process with  
one hundred percent of the cost of the Special Energy  
Improvement Project being assigned to the specially benefited  
Property. This resolution accepts and approves the petition from  
Petitioner, to begin that special assessment process, and is  
accompanied by an ordinance to proceed with Petitioner. When  
the Special Energy Improvement Project is complete and the final  
costs known, an assessing ordinance directing that the necessary  
Special Assessment be made against the benefited Property will  
be presented to the Council.

The cost of the Project will be funded through a loan from  
the Toledo-Lucas County Port Authority’s Northwest Ohio  
Bond Fund. Ultimately, the loan will be repaid over time  
from the Special Assessments paid by Petitioner.  
Petitioner, in turn, is expected to be able to pay a portion

improve the economic welfare of the people of the City, the City  
has submitted an application (the Application) to the United  
States Department of Housing and Urban Development (HUD) for  
loan guarantee assistance under Section 108 of the Housing and  
Community Development Act of 1974, as amended (42 U.S.C.  
§5308), in the principal amount of not to exceed $2,000,000 to

provide funds necessary for the City’s Department of Housing and  
Community Development to finance acquiring and installing  
furniture, fixtures and equipment for and improving the Delta  
Hotel by Marriott and its site (the Project).  
The City has now received from HUD the agreements that are  
to be entered into by the City for the loan guarantee assistance  
program and this Council wishes to authorize the execution of  
those agreements and to issue special limited obligation revenue  
notes (the Notes) pursuant to the laws of the State of Ohio,  
including Sections 13 of Article VIII of the Ohio Constitution, to  
evidence the loan to be obtained by the City under that loan  
guarantee assistance program and to authorize the pledge of  
certain funds pursuant to the requirements of HUD, including the  
City’s present and future Community Development Block Grants  
as security for the repayment of the Notes.

purchase of street sweepers for Urban Beautification programs.  
The department issued a competitive bid proposal for the purchase  
of three (3) Elgin Pelican street sweepers. The winning bid cost  
per vehicle is $325,200, so an additional $75,600 is needed to  
complete the purchase of a third street sweeper. The department

needs a third sweeper to help replace aging equipment and in  
order to have back-up equipment readily available when machines  
are out of service. The department has utilized the Elgin Pelican  
sweepers for more than thirty years and they are very popular  
among municipalities. The time required to request and receive  
new equipment can exceed six to twelve months, therefore, the  
purchase of this third street sweeper now will save procurement  
time in the future and help Urban Beautification optimize its core  
services faster.  
The division would like to utilize the remaining balance of  
ordinance 160-24 to supplement the purchase of a third street  
sweeper.

day. The spentlime entering the presses has a solid content  
of 4-5%, which increases to 45-50% after processing. A  
mixer is used to keep solids suspended; if the mixer  
malfunctions, the solids content drops to about 3-4%  
before pressing. Higher solid content going into the  
presses results in a higher percentage of solids coming out.  
Currently, only one mixer is in operation, and there is no  
functional spare available if it fails.
