SUMMARY & BACKGROUND:

The Division of Engineering and Construction Management has been working closely with ODOT to secure grant funding through multiple funding programs for several projects.  All amounts are grant dollars and are assigned to specific projects as follows:

 

A maximum of $500,000 has been allocated by ODOT through TMACOG for a resurfacing project; Laskey Road from Douglas Road to Jackman Road. Matching funds will be provided through the Division of Engineering and Construction Management Matches and Planning budget. Construction for this project is scheduled for 2024.

 

A maximum of $2,155,728 has been allocated by ODOT through TMACOG for a streetscape project; Anthony Wayne Trail from South Detroit Avenue to Glendale Avenue. Matching funds will be provided through the Division of Engineering and Construction Management Matches and Planning budget. Construction for this project is scheduled for 2023.

 

Passage of this ordinance is required to enable the City of Toledo to accept outside funding for these projects and have it in place to help pay for these expenditures.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.                       That the Mayor is authorized to enter into and execute cooperative agreements with and accept financial assistance from the State of Ohio Department of Transportation (ODOT) for various projects upon such terms and conditions shall be approved by the Director of Transportation and the Director of Law.

 

SECTION 2.                     That the Mayor is authorized to accept and deposit grant proceeds from ODOT into the Capital Improvement Fund in an amount not to exceed $2,655,728 for the following projects:

SECTION 3.  That an amount not to exceed $2,655,728 is appropriated from the grant proceeds of the Capital Improvement Program Fund into the Account Codes listed in Section 2 for the projects listed above; and authorizing expenditure of same.

 

SECTION 4.   That the mayor is authorized to prepare plans and specifications and to enter into contracts after accepting bids according to law in an amount not to exceed $2,655,728 for the projects including such items as labor, materials, construction testing, professional services, property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way. Contracts shall contain such terms and conditions as the mayor may deem requisite and proper and shall be subject to approval by the Director of Transportation and the Director of Law.

 

SECTION 5.  That the Finance Director is authorized to issue his warrant or warrants against the Account Codes identified in Section 2 in an amount not to exceed $2,655,728 in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.

 

SECTION 6.                      That the disappropriation of any remaining budget to fund balance is authorized at project closeout.

 

                     SECTION 7.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate the planning and construction of these projects.
