Amending Ordinance 399-22 to add additional funding for the purchase and installation of a flush restroom facility at Cullen Park; and declaring an emergency.

SUMMARY & BACKGROUND:
Ordinance 399-22 authorized expending up to $200,000 for the purchase and installation of a flush restroom facility at Cullen Park. Due to the fact that a majority of Cullen Park falls within the 100-year floodplain, the restroom facility had to be perched above the flood zone. As a result, ramps, steps, and additional site balancing were required to implement this project. The original ordinance is being amended to add $77,690 in additional funding to cover this work. All Funds for this project are included in the approved Capital Improvement budget.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That Section 1 of Ordinance 399-22 which reads as follows:
SECTION 1. The expenditure of an amount not to exceed $200,000 is authorized from the Capital Improvement Fund Account Code 5040-26100-8CP2223CULRES for the purchase and installation of a flush restroom facility at Cullen Park.
is repealed.
SECTION 2. That a new Section 1 of Ordinance 399-22 is enacted to read as follows:
SECTION 1. The expenditure of an amount not to exceed $200,000 is authorized from the Capital Improvement Fund Account Code 5040-26100-8CP2223CULRES and $77,690 from Park Infrastructure Improvements Fund Account Code 5040-40100-8CP2230PRKINF for the purchase and installation of a flush restroom facility at Cullen Park.
SECTION 3. That Section 3 of Ordinance 399-22 which reads as follows:
SECTION 3. That the Finance Director is authorized to draw warrant or warrants against the above account code in payment of the above authorized obligations in amounts not to exceed $200,000 upon presentation of the proper voucher or vouchers.
is repealed.
SECTION 4. That a new Section 3 of Ordinance 399-22 is enacted to read as follows:
SECTION 3. That the Finance Director is authorized to draw warrant or warrants against the above account codes in payment of the above authorized obligations in amounts not to exceed $277,690 upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective in order to timely construct the Cullen Park restroom facility for proper and safe use.
