SUMMARY & BACKGROUND:

Congress appropriated $5 billion in American Rescue Plan funds to be administered through the HOME Investment Partnerships Program (HOME-ARP) to address the need for homelessness assistance and supportive services.  The City of Toledo has received a HOME-ARP allocation of $7,900,932.  Pursuant to the HOME-ARP Grant Agreement and Requirements for the Use of Funds in the HOME-American Rescue Plan Program (“Notice”), and

Ordinance 620-21, the City has received five percent (5%) or $395,046.60 of the HOME-ARP allocation for administrative and planning costs including the development of a HOME-ARP Allocation Plan.  In order to receive the remaining $7,505,885.40 of HOME-ARP funding, a HOME-ARP Allocation Plan must be approved and submitted as a Substantial Amendment to the FY 2021-2022 Annual Action Plan.

 

The HOME-ARP Allocation Plan has been created in consultation with homeless services providers and stakeholders, it contains a needs assessment and gap analysis to evaluate how HOME-ARP funding will be distributed and prioritized for the needs of the following Qualifying Populations: homeless; at risk of homelessness; fleeing, or attempting to flee domestic violence, dating violence, sexual assault, stalking, or human trafficking; part of other populations where providing supportive services or assistance would prevent a family’s homelessness or would serve those with greatest risk of housing instability; and veterans and families that include a veteran family member that meet one of the criteria of other HOME-ARP Qualifying Populations. 

 

The eligible HOME-ARP activities are: planning and administrative costs, development and support of affordable housing; tenant-based rental assistance (TBRA); provision of supportive services; and acquisition and development of non-congregate shelters. The draft HOME-ARP Allocation plan is attached as Schedule A. Schedule B provides the HOME-ARP Grant budget. HOME-ARP funds expire in 2030.

 

The financial impact of this Ordinance is the receipt of $7,505,885.40 from HUD to provide housing, services and shelter to HOME-ARP Qualifying populations.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1. That the Mayor is authorized to submit the HOME-ARP Allocation Plan, a Substantial Amendment to the 2021-2022 Annual Action Plan to HUD.

 

SECTION 2. That the Mayor is authorized to accept and deposit the remaining $7,505,885.40 HOME-ARP Grant from HUD into Account Code 2025-16200-5GH3002STDARP (Toledo HOME-ARP Program Fund); further authorizing the appropriation and expenditure of same pursuant to HUD regulations and the attached Schedule B.

 

SECTION 3. That the Mayor is authorized to enter into the necessary contracts or agreements to implement the activities and programs described in the HOME-ARP Allocation Plan, a Substantial Amendment to the 2021-2022 Annual Action Plan, upon such terms and conditions as acceptable to the Director of Housing and Community Development and the Director of Law.

 

                     SECTION 4.  That the Finance Director is authorized to issue warrant or warrants against Account Code 2025-16200-5GH3002STDARP in an amount not to exceed $7,505,885.40 from the HOME-ARP fund in payment of all authorized obligations and upon presentation of the proper voucher or vouchers.

 

SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency is the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to allow the City of Toledo to submit the HOME-ARP Allocation Plan, a Substantial Amendment to the 2021-2022 Annual Action Plan, qualify under the regulations of the HOME-ARP Program, and to receive the money necessary to carry out eligible activities identified in the HOME-ARP Allocation plan.
