SUMMARY & BACKGROUND:

Ordinance 479-20 authorized acceptance of grant funds under the Ohio Environmental Protection Agency’s (“OEPA”) Lead Service Line Inventory and Mapping Grant.  The OEPA has offered the City of Toledo additional funding as an expansion of this program, and has invited the City to enter into another grant agreement for an amount up to $50,000 to be used for the Lead Service Line Mapping Expansion Project. This ordinance authorizes the mayor to accept, deposit, appropriate and expend an amount not to exceed $50,000 in grant proceeds.

 

Blue Conduit, the vendor currently working under contract with the City, as authorized under Ordinance 135-21, to create and map lead service lines, can continue its work under this Expansion which will avoid delays and expense in rebidding and retraining a potentially new vendor to do this Expansion work.  Blue Conduit will model and map water service lines in the parts of Lucas County that are outside of Toledo’s limits but are serviced by Toledo water. This legislation will authorize the mayor to execute the necessary supplemental contract amendment to extend Blue Conduit’s contract with the City, authorize paying Blue Conduit an amount not to exceed $50,000 for the mapping as described, and waive all competitive bidding requirements in TMC 187. The funds made available through this grant will be used to reimburse the City for up to $50,000 in expenses paid to Blue Conduit for this additional work.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.                      That the mayor is authorized to enter into a grant agreement with the Ohio Environmental Protection Agency for the Lead Service Line Mapping Expansion upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.

 

SECTION 2.                      That the mayor is authorized to accept and deposit grant proceeds from the Ohio Environmental Protection Agency in an amount not to exceed $50,000 into the Operation Grants Fund, Account Code 2016-38000-6G00307STDSTD, for the purpose of completing work necessary to administer the grant.

 

SECTION 3.                      That the appropriation from the unappropriated grant proceeds in an amount not to exceed $50,000 is authorized from the Operation Grants Fund into Account Code 2016-38000-6G00307STDSTD; and further authorizing the expenditure of same for the Lead Service Line Mapping Expansion project.

 

                     SECTION 4.                     That this Council finds and determines that it is in the best interest of the City to waive the competitive bidding requirements of TMC 187 for the reason that using the existing vendor will prevent any delays and expenses in locating lead service lines for removal.

 

                     SECTION 5.                      That the mayor is authorized execute the necessary supplemental contract amendment with Blue Conduit as related to this grant upon such terms and conditions as shall be approved by the Director of Public Utilities and the Director of Law.

                     

SECTION 6.                      That the Director of Finance is authorized to issue their warrant or warrants against the account codes above in amounts not to exceed those authorized above in payment of the obligations incurred pursuant to the above-authorized contracts upon presentation of proper voucher or vouchers.  

                     

SECTION 7.                      That this Ordinance is declared to be an emergency and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the city and for the further reason that this ordinance must be immediately effective in order to implement this program within the Environmental Protection Agency’s designated time schedule.
