SUMMARY & BACKGROUND:
This Ordinance amends Toledo Municipal Code Chapter 136, Department of Economic Development, and removes Inspection as a division under Economic Development previously combined in 2015. It provides for appointment of a Director and Deputy Director.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the existing Toledo Municipal Code (“TMC”) Chapter 136 which reads as follows:

136.01 Establishment

136.01 Establishment
There is hereby established the Department of Economic and Business Development.
136.02 Appointment of Director and Commissioner.
(a) The Director of the Department of Economic and Business Development shall be appointed by the Mayor in the manner provided by the Charter and shall serve at the pleasure of the Mayor.
(b) The Director shall be accountable to the Mayor and is responsible for the effective administration of the various divisions, sections, offices and programs within the Department.
(c) The Commissioner of Building Inspection shall be appointed by the Mayor in the manner provided by the Charter and shall serve at the pleasure of the Mayor.
136.021 Chief Building Official (CBO).
(a) The City shall have in its employ an architect or professional engineer registered in the State of Ohio having at least five (5) years experience in building construction or design and who holds the State certification of Building Official. Said professional architect or engineer shall be designated by the Mayor and approved by City Council as the City's Chief Building Official (CBO). In all matters of building code compliance and enforcement, the Chief Building Official shall be the City's final authority.
(b) The Chief Building Official shall perform the duties identified by the Ohio Board of Building Standards as appropriate to a Building Official. The Chief Building Official
shall supervise the activities of the City-employed, State-certified staff of plan reviewers, inspectors and the Residential Building Official.
(c) The Chief Building Official shall accept and approve reports from fire safety plan reviewers and inspectors for structures covered by the Ohio Building Code and the Residential Code of Ohio.
(d) The Chief Building Official shall be the City's Floodplain Administrator and shall implement and administer the City's floodplain management procedures and policies.
(e) In the temporary absence of the Chief Building Official, a City-employed person who holds the State certification of Building Official, and has been designated to the State's Board of Building Standards as an alternate CBO, shall assume the CBO's responsibilities.
136.03 Divisions, sections, offices, and programs within Department.
(a) Division of Economic and Business Development.
(1) Financial Assistance Section.
(2) Real Estate Section.
(3) Downtown Development Section.
(4) Neighborhood Development Section.
(b) Division of Inspection.
is repealed.
SECTION 2. That a new TMC Chapter 136, Department of Economic Development is enacted to read as follows:

Department of Economic Development
136.01 Department of Economic Development established; purpose
136.02 Appointment of Director, duties.
136.03 Appointment of Deputy Director, duties.
136.01. Establishment.
The Department of Economic Development is established as an administrative department of the City. The purpose of the Department of Economic Development is to facilitate private sector investment, job retention and creation, and income growth in the City through the development and implementation of strategies, programs and initiatives that improve the competitive position of the City for the retention, expansion and attraction of businesses in the City and strategically within the region.
136.02 Appointment of Director.
The Director of the Department of Economic Development shall be appointed by the Mayor in the matter provided by the Charter and shall serve at the pleasure of the Mayor. The Director shall be accountable to the Mayor and is responsible for the effective administration and operations of the Department of Economic Development in accord with the Charter, Municipal Code and applicable ordinances. The Director shall make recommendations to the Mayor and Council related to development policies and strategies to encourage economic growth in the City, including business investment, job creation and retention. The Director shall also serve or as member of the Board of the Toledo Community Improvement Corporation (“TCIC”) and may designate and assign development staff to serve as executive staff for the Toledo Community Improvement Corporation at the request of the TCIC Board of Directors.
136.03 Appointment of Deputy Director.
The Deputy Director of the Department of Economic Development shall be appointed by the Mayor in the manner provided by the Charter and shall serve at the pleasure of the Mayor. The Deputy Director shall serve as the Acting Director in the absence or unavailability of the Director. The Deputy Director shall report to the Director and shall perform such other duties as may be prescribed by the Director of Economic Development or the Mayor.
SECTION 3. That it is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were passed in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
SECTION 4. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that it is necessary for continuing economic development operations and to timely engage in planning and implementation of programs and initiatives to address important community economic development needs and opportunities.
