SUMMARY & BACKGROUND:
This Ordinance authorizes the appropriation and expenditure of resources from the general fund for the purchase off alternate daily landfill cover material from LSC Environmental Products, LLC (LSC) for the Hoffman Road Landfill (landfill). The landfill is required to apply a daily cover on the active working face in accordance with Ohio Administrative Code (OAC) 3745-27-19. LSC manufactures a spray-applied mulch and mineral mortar slurry cover material (VERDac™) used at various landfill facilities across the U.S. VERDac™ is only manufactured by LSC and is more cost effective and advanced relative to previously used spray-applied cover products and is an approved material for alternate daily cover in the U.S.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the mayor is authorized to execute a one-year contract with up to three one-year renewals with LSC Environmental Products, LLC to purchase spray-applied cover material for use at the Hoffman Road Landfill, upon such terms and conditions as acceptable to the Director of Public Service and the Director of Law.
SECTION 2. That subject to annual appropriation the annual expenditure of an amount not to exceed $100,000 is authorized from the General Fund, Account Code 1001-24500-6232002STDSTD for the purpose referenced in Section 1.
SECTION 3. That Council finds and determine that is in the best of interest of the City to waive the competitive bidding process as required under Chapter 187 of the Toledo Municipal Code for the materials in Section 1 are only manufactured by LSC Environmental Products, LLC and are more cost effective and advanced relative to previously used spray-applied cover products and are an approved material for alternate daily cover in the U.S.
SECTION 4. That the Finance Director is authorized to draw their warrant or warrants against the above Account Code in an amount not to exceed $100,000 annually in payment of all above authorized obligations upon presentation of proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order for the City of Toledo to ensure that the Hoffman Road Landfill continues to operate in a manner supportive of continuous daily city services to the community and in compliance with the applicable regulatory requirements.
