SUMMARY & BACKGROUND:
It is well documented that high levels of lead in water create serious health risks to residents, particularly young children. The use of lead service lines between public water mains and private properties increases the risk that the lead content of drinking water to the properties served will increase to a dangerous level. The Ohio EPA and federal regulators have recently implemented more stringent requirements regarding lead in water and are in the process of further tightening these restrictions as more data and science become available in the aftermath of places like Flint, Michigan. Toledo seeks to expend $10,000,000 of ARPA money to eliminate private lead service lines via accompanied proposed Ordinance. Programs like these are starting to be implemented all over the country including Cincinnati, who also took this step of prohibiting lead service lines.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That Toledo Municipal Code Section 939.19, Lead Service Lines Prohibited, which reads as follows,

939.19. Lead Service Lines Prohibited.

The Director of Public Utilities shall not approve the installation of any new service line or the replacement of any existing service line with pipe that is not lead-free. Lead Service Lines are prohibited.

It is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were passed in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with ...
