SUMMARY & BACKGROUND:
Mondelez International has requested permission to install an Electronic Message Center at 2221 Front Street, in the Maumee River Overlay District. The purpose of the sign is to provide directions for truck traffic entering Front Street in order to provide a safe and efficient traffic pattern for the approximately 100 trucks per day entering the facility. EMCs are prohibited in the Maumee River Overlay District by Toledo Municipal Code Section 1389.06(a)(1). The placement of this sign will not result in light facing the river side of the property. It is in the interest of public safety to waive TMC 1389.06(a)(1) to allow an EMC for traffic control at 2221 Front Street.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That Toledo Municipal Code Sections 1389.06(a)(1) is waived to allow a new Electronic Message Center in the Maumee Overlay District at 2221 Front Street, in the City of Toledo, Lucas County, Ohio.

SECTION 2. That all formal actions concerning and relating to the passage of this Ordinance were passed in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

SECTION 3. That this Ordinance hereby is declared to be an emergency measure and shall be in force and effect from and after its passage.
