Title
Authorizing a two-year agreement between the Facility Governing Board; henceforth referenced as the “Facility” of the Correctional Treatment Facility; henceforth referenced as “CTF” and Toledo Municipal Court; henceforth referenced as “TMC” for the provision of addiction diversion program services to TMC through CTF’s Regional Addiction Diversion program; henceforth referenced as “RAD”; authorizing biennial expenditures of $1,012,510 for the two-year contract, waiving the requirements of TMC 187 and making certain findings with respect thereto; and declaring an emergency.

SUMMARY & BACKGROUND:
This Ordinance authorizes an agreement between TMC and the Facility for the provision of addiction diversion program services through the Facility’s RAD program to criminal defendants in the TMC. The Agreement is for two-years (7/1/2021 through 6/30/2023) with a renewal option of 24 months (7/1/2023 through 6/30/2025). Any changes in fees and per diem rates for the extension period shall be included in the written agreement.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. The Mayor, the Municipal Court Judges, and the Municipal Court Administrator are authorized to enter into this agreement for a two-year term, with an option for a two-year extension, with the Facility for the provision of addiction diversion program services through the Facility’s RAD program.
SECTION 2. The competitive procurement requirements under Toledo Municipal Code Chapter 187 are waived as it is found and determined that it is in the best interest of the City that contracting with the Facility is the most cost effective and secure manner to obtain the needed addiction diversion services.
SECTION 3. The expenditures of funds in the amount of $1,012,510.00 for the two-year contract is authorized from the Account Code 2016/10800/3G00064STDSTD in the amount of $506,255; Account Code: 1001/10800/3000257STDSTD in the amount of $253,127.50; Account Code: 2090/10800/3T18910STDSTD in the Amount of $253,127.50, subject to the appropriation of funds in future years.
SECTION 4. The Finance Director is authorized to draw his warrant or warrants against the above referenced account code in payment of the above obligations upon presentation of the proper voucher or vouchers.
SECTION 5. This Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that the Ordinance must be immediately effective in order to provide continued addiction diversion program services through the Facility’s RAD program to criminal defendants.
