SUMMARY & BACKGROUND:
The Special Use Permit is a process which attempts to afford the optimal means by which the City of Toledo can ensure the appropriate operation of a business and attempt to mediate possible secondary negative effects early on in the process. Too often a business obtains a Special Use Permit and agrees to all the terms and conditions set forth in the report. It can be years before the city can file orders against the permit holder which fails or neglects to meet those terms and conditions. This will now require compliance in the beginning and if there is an issue with negative secondary effects, they may also be addressed.

Summary
NOW, THEREFORE, Be it resolved by the Council of the City of Toledo:

SECTION 1. That the Toledo City Plan Commission establish the following standards through new sections within Toledo Municipal Code Section 1104.0602 for requiring a Special Use Permit.

TMC. 1104.0602 E. The Special Use Permit approval will contain a condition that all Special Use Permits granted will be automatically reviewed annually for no less than three years to determine compliance with conditions set forth in the permit and any negative secondary effects from such Special Use. This in no way negates the ability for an annual review in the future.
TMC. 1104.0602F. If the City of Toledo files any action in Court, involving code enforcement or from police, regarding a location that has a Special Use Permit granted, a Plan Commission review shall be required to determine rev...
