Repeal Ord. 198-21 in its entirety, which was an alley vacation behind 210 Charles St.; and declaring an emergency.

SUMMARY & BACKGROUND:

On April 13, 2021, City Council passed Ord. 198-21, which was an alley vacation behind 210 Charles St. between the A.W. Trail and Curtis St.  The applicant, Stephen Darrington Jr., subsequently has decided not to proceed with this alley vacation.  This ordinance will repeal in its entirety Ord. 198-21.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That Ord. 198-21 is hereby repealed in its entirety.

                     

SECTION 2.  That this Ordinance is hereby declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective so that the alley vacation behind 210 Charles St. is not recorded and effective.

 

                     Vote on emergency clause:  yeas 12, nays 0.

 

Passed:  May 11, 2021, as an emergency measure:  yeas 12, nays 0.
