SUMMARY & BACKGROUND:
City of Toledo Water Distribution personnel working in the area of 1615 Starr Avenue, Toledo, Ohio on December 23, 2019 cut AT&T's underground fiber optic duct and cable, for which the City of Toledo was billed $25,595. Settlement of the claim has been reached in the amount of $20,595.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the expenditure of $20,595 is authorized from the Risk Management Fund Account Code 7095-12000-1157001STDSTD for payment for settlement of the claim of AT&T Ohio.
SECTION 2. That the payment of this claim is contingent upon the execution of the proper release by AT&T Ohio.
SECTION 3. That the Director of Finance is authorized to draw warrant or warrants to in payment of the above authorized obligations in the amount of $20,595 against the above Account Code upon presentation of the proper vouchers.
SECTION 4. That this Ordinance, being an emergency measure, shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to implement the settlement in accordance with the conditional agreement of the Administration.
