Authorizing the disappropriation of $23,975 from the Capital Improvement Fund; authorizing the appropriation and expenditure of $23,975 from the Capital Improvement Fund for the replacement of the Macelwane Park play system; and declaring an emergency.

SUMMARY & BACKGROUND:
With cemetery management now contracted out, these funds are more appropriately spent on replacing an outdated play system in Macelwane Park. The neighborhood is heavily engaged in revitalizing this park, and the play set was identified as a high priority for replacement to serve the numerous families with young children that live nearby.
The fiscal impact of this Ordinance is as follows:

Summary
NOW THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the disappropriation of $23,975 is authorized from the Capital Improvement Fund, Account Code 5040-60500-8CP1922VLTHST.
SECTION 2. That an amount not to exceed $23,975 is appropriated from the unappropriated balance of the Capital Improvement Fund to 5040-60500-8CP1904PRKINF; and further authorizing the expenditure of the same for the replacement of the Macelwane Park play set.
SECTION 3. That the mayor is authorized to accept bids and award contracts for the purposes specified in Section 2 upon such terms and conditions are deemed appropriate by the Director of Public Service and the Director of Law.
SECTION 4. That the Finance Director is authorized to draw her warrant or warrants against the account code listed in Section 2 above, in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and to allow the contracts to be processed so the work can be completed for the greater enjoyment of the neighborhood.
