Title

Authorizing the appropriation and expenditure of an amount not to exceed $115,000 from the unappropriated balance of the Stormwater Utility Improvement Fund for the Silver Creek Phase 4 survey; authorizing the mayor to accept bids and to execute the necessary contract(s) after due advertising; and declaring an emergency.

SUMMARY & BACKGROUND:

This ordinance funds the completion of survey data needed for the design of ditch improvements on Silver Creek from Jackman Road to Clegg Drive.  This work continues improvements made to the downstream sections of Silver Creek in 2013 and 2014 along with culvert improvements scheduled for construction in 2020.  (Lining project)

The fiscal impact of this ordinance is as follows:

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That an amount not to exceed $115,000 is appropriated from the unappropriated balance of the Stormwater Utility Improvement Fund, into Account Code 607B-35000-4UC2619STDSTD; and authorizing expenditure of the same for the Silver Creek Phase 4 survey.

 

                     SECTION 2. That the mayor is authorized to accept bids and to execute the necessary contract(s), after due advertising, for the Silver Creek Phase 4 survey. Said contracts shall contain such terms and conditions as the mayor may deem requisite and proper, and shall be subject to approval by the Director of Law and the Director of Public Utilities.

 

                     SECTION 3.  That the Director of Finance is authorized to issue his warrant or warrants against the account code listed in Section 1, in an amount not to exceed $115,000 and to make the necessary expenditures in payment of the obligations incurred pursuant to the contract(s) authorized in Section 2 upon presentation of the proper voucher or vouchers.

 

                     SECTION 4. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.

 

SECTION 5. That this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this ordinance must be immediately effective in order to permit the earliest possible start of survey data needed for Silver Creek ditch improvements.

 

                     Vote on emergency clause:  yeas 12, nays 0.
