Title

Authorizing the expenditure not to exceed $105,000 from the Capital Improvement Fund District Improvement Program for the purchase and installation of decorative streetlights along Sylvania Avenue from approximately Douglas Road to Secor Road on the north side of the roadway; authorizing the Mayor to accept bids and to execute the necessary contract(s); and declaring an emergency.

SUMMARY & BACKGROUND:

The West Oak Walk Business Association (WOW), a business organization in District 5, submitted a District Improvement Program application for the installation of eleven (11) decorative light posts on the north side of Sylvania Avenue between Douglas and Secor to enhance the quaintness of the business district. The lights would be in addition to the current light inventory, but would be more energy efficient and would be the first decorative lights in the area. Additionally, WOW proposes upgrading the existing thirty (30) streetlights to light emitting diode (LED) lighting for aesthetics and security. The District Improvement Review Committee convened on April 4, 2019, and recommended approval of this application in an amount not to exceed $115,320.

 

This ordinance is requesting the expenditure of $105,000 from the Capital Improvement Fund which was appropriated under Ord. 201-18.  Further Res. 228-19 was enacted to begin the assessment process.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That a sum not to exceed $105,000 is authorized for expenditure from the Capital Improvement Fund, Account Code 5040-16400-8CP1817DNGPRO for the (11) decorative light posts on the north side of Sylvania Avenue between Douglas and Secor for the District Improvement Program, Sylvania Avenue Decorative Light Project, as detailed in Attachment A.

 

                     SECTION 2.  That this Ordinance for street lighting improvements is referred to the Department of Public Service for further processing pursuant to the Toledo Municipal Code and Charter.

 

                     SECTION 3.  That a portion of Sylvania Avenue between Douglas and Secor is specifically benefited by said improvements and shall be assessed at the rate per assessed front foot representing that part of the cost of lighting said streets or portion of said streets abutting said lots and lands.

 

                     SECTION 4.  That the assessments so to be levied and assessed shall be levied and assessed annually in accordance with the assessing Ordinance hereafter to be passed by the Council and shall be certified to the County Auditor to be placed upon the tax duplicate and collected as other taxes.

 

                     SECTION 5.  That the remainder of the cost and expense of said improvement, not specially assessed, together with damages, if any, awarded to the owner of adjoining lands, with interest thereon, and the costs and expenses of any such award, shall be paid by a levy upon the general tax list made by the City for such purpose in the manner provided by law.

 

                     SECTION 6.  That notice of the adoption of this Ordinance shall be by publication in the Toledo City Journal in the manner provided by law.

 

 

 

SECTION 7.  That the Mayor is authorized to accept bids and to execute the necessary contract(s) for the (11) decorative light posts in the District Improvement Program, Sylvania Avenue Decorative Light Project upon such terms and conditions as shall be approved by the Director of the Department of Neighborhoods and Business Development, the Director of Public Service and the Director of Law.

                                                                                                         

                     SECTION 8.  That the Director of Finance is authorized to draw warrant or warrants against the above account code in payment of the above authorized obligations in an amount not to exceed that authorized in Section 1 upon presentation of the proper voucher or vouchers.

 

                     SECTION 9.  That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and so that this project can be initiated as soon as possible for lighting enhancement.
