SUMMARY & BACKGROUND:

By application (SUP-11003-18) filed with the City of Toledo Central Permit Center, a request for a Special Use Permit for Community Recreation- Active for a new Metropark for a site located at 0 Riverside Drive, the City of Toledo, Lucas County, Ohio; was submitted to the Toledo City Plan Commission for its review and recommendation.

 

On January 10, 2019, the Toledo City Plan Commission recommended approval for a Special Use Permit for Community Recreation- Active for a new Metropark for a site located at 0 Riverside Drive, in the City of Toledo, Lucas County, Ohio.

 

On February 13, 2019, Toledo City Council, Planning and Zoning Committee reviewed, and sent as approved a Special Use Permit for Community Recreation- Active for a new Metropark for a site located at 0 Riverside Drive, City of Toledo, Lucas County, Ohio; and all other things required by law to be done, have been done.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That a Special Use Permit for Community Recreation- Active for a new Metropark for a site located at 0 Riverside Drive, City of Toledo, Lucas County, Ohio; be and the same is hereby approved, subject to the conditions contained in Section 2 hereof which must be complied with, as to the property more fully described as follows:

 

Legal Description North of Riverside: Being Lots “A” “B” and “C” in the plat of Marina District Deux as recorded in Lucas County O.R. 20180724-0031712, together with Lots 1 and 2 in the plat of the New Waterfront Metropark as recorded in Lucas County O.R. 20180725-0032017 together with Lot 7 in the plat of the Marina District as recorded in Lucas County O.R. 20081008-0049841 together with Part of Lots 1 and 2 in Wilson’s Addition to the City of Toledo as recorded in Lucas County Plat Volume 17, Page 21, together with part of Vacated Dearborn Avenue, together with part of Section 31, Town 9 South, Range 8 East, together with part of the public road Right-of-way of Front Street, together with part of the Limited Access Right-of-ways of I-280 and S.R. 65, all being in the City of Toledo, Lucas County, Ohio, bounded and described as follows:

 

Commencing at 1 inch iron bolt monument found at the intersection of the centerlines of Main Street and Riverside Drive.

Thence South 32 degrees, 49 minutes, 16 seconds East, along the Northeast line of Lot 2 in New Waterfront Metropark, and passing an aluminum plate monument set at 147.23 feet, an overall distance of 272.23 feet to an aluminum plate monument set on the Northwest Right-of-way of Riverside Drive, as recorded in the plat of the Marina District.

Bearings used herein are based upon an assumed meridian and are intended to indicate angular measurement only. All 1/2 inch galvanized steel pipe set are capped with the company name and PLS No. 7476. This legal description is based upon a combination of field surveys prepared by Lewandowski Engineers and record plat data.

 

SECTION 2.                      That the approval of the Special Use Permit for Community Recreation- Active for a new Metropark for a site located at 0 Riverside Drive, City of Toledo, Lucas County, Ohio; shall be subject to compliance with the 4 conditions as follows:

 

The following four (4) conditions are listed by agency of origin.  Applicants are encouraged to contact each of the agencies to address compliance with their conditions.

1.                     The Special Use Permit may be reviewed for compliance with the conditions of approval, negative secondary effects, and adherence to all requirements of the Toledo Municipal Code.  If outstanding issues are found and not addressed the Special Use Permit may be considered for revocation.

 

2.                     Approval of the Special Use Permit will lapse after one (1) year if the criteria listed in TMC§1111.0707 have not been met.

 

3.                     Minor adjustments to the Site Plan that do not violate the above conditions, or the Toledo Municipal Code, may be reviewed and approved by the Director of the Toledo City Plan Commission.

 

4.                     No permits shall be issued until arrangements satisfactory to the Director of the City of Toledo Plan Commission have been made for compliance with the conditions as set forth above.

 

                     SECTION 3.  That when the conditions contained herein above have been complied with, the Secretary of the Toledo City Plan Commission be and he is hereby directed to change the zoning maps to conform with the within Ordinance.

 

                     SECTION 4.  That this Ordinance hereby is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order to provide for the orderly regulation and use of the property and to protect the land value in the area.
