Central Ave.; authorizing the Mayor to enter into the necessary contract for said emergency repairs; waiving the competitive procurement requirements of Chapter 187 of the Toledo Municipal Code and making certain findings with respect thereto; and declaring an emergency.

SUMMARY & BACKGROUND:
This Ordinance authorizes expending $51,000 from Facility Operations’ approved 2018 CIP funds for contractual services for the emergency repair to the boiler system located at 1189 W. Central Ave. (Streets, Bridges and Harbor).
The boiler system located at 1189 W. Central Ave. (Streets, Bridges and Harbor) has failed unexpectedly and is not repairable. This boiler is the only source of heat for the administrative offices and is critical in being replaced to prevent further damage to the building’s heating system.

NOW THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the sum of $51,000 is authorized for expenditure from the Capital Improvement Fund Account Code 5040-26100-8CP1811HVACMA for emergency repairs to the boiler system.
SECTION 2. That the Mayor is authorized to enter into the necessary contract with Mondo Mechanical for the emergency repair of the boiler system in a total amount not to exceed $51,000, upon terms and conditions as approved by the Directors of Law and Public Service.
SECTION 3. That City Council finds that it is in the best interest of the city that the competitive procurement requirements of Chapter 187 of the Toledo Municipal Code are waived for the reason that emergency repairs are needed to keep the building operational and to maintain uninterrupted operations and for the further reason that repair cost has been deemed reasonable by the Director of Public Service.
SECTION 4. That the Director of Finance is authorized to draw warrant or warrants against Account Code 5040-26100-8CP1811HVACMA in an amount not to exceed $51,000 in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to complete emergency repairs and to maintain uninterrupted operations.
