SUMMARY & BACKGROUND:

The Cal Ripken Sr. Foundation is a national 501(c)(3) nonprofit organization founded in 2001 to honor the legend and spirit of Cal Ripken, Sr. through transformational at-risk youth programs, youth development parks, and multi-purpose parks. The Foundation works with communities to create safe opportunities for youth to develop valuable life skills, build character, connect positively with local law enforcement, and learn how to make productive choices for their future. The Foundation is working in local communities across the country to develop and construct synthetic-surface youth development parks. These multi-purpose, low-maintenance facilities serve as outdoor classrooms designed to provide recreational, educational, and athletic experiences. This ordinance allows the City of Toledo to enter into a 20-year lease agreement with one ten (10) year renewal with the YMCA of Greater Toledo and the Historic South Initiative as tenants. Additionally, the City of Toledo will contribute $300,000 from the Capital Improvement Fund in order to assist with project development and construction. Upon completion of construction, the YMCA will operate the facility. Contingent on passage of this ordinance and the lease, the YMCA and Historic South Initiative have negotiated a development agreement with the Cal Ripken Foundation Sr. which will assume full responsibility for construction of the youth development park.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1. That the mayor is authorized to enter into a lease agreement with The YMCA of Greater Toledo and Historic South Initiative and a development agreement with the Cal Ripken Sr. Foundation for the construction and operation of a youth development park located at Danny Thomas Park - 2538 Broadway Street. The leased premises being described in the attached Exhibit “A.”

 

SECTION 2. That an expenditure of $100,000 is authorized from the Capital Improvement Fund, account code 5040-60500-8CP1813DTWALL, and the expenditure of $200,000 is authorized from the Capital Improvement Fund account code 5040-60500-8CP1833DANPRK for the contribution to the Cal Ripken Sr. Foundation, Inc. for the construction of a Youth Development Park.

 

                                                                                                         SECTION 3. That the Finance Director is authorized to draw warrant or warrants against the proper accounting codes in payment of the obligations hereinabove authorized upon presentation of the proper voucher or vouchers.

 

                     SECTION 4.  That Council finds and determines that waiver of the competitive bidding and notice requirements of Toledo Municipal Code 187.19 is in the best interest of the City for the reason that the YMCA of Greater Toledo and Historic South Initiative as tenants in affiliation with the Cal Ripken Sr. Foundation and its significant financial contribution to the Youth Development Park is a unique opportunity for substantial recreational investment for the direct benefit of the youth in the community. 

 

                     SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that the Ordinance must be immediately effective in order to ensure that the Youth Development Park is timely constructed.
