Title

SUMMARY & BACKGROUND:

City Council is interested in conducting a feasibility study for a Toledo-Detroit Rail Ridership Feasibility & Cost Estimate Study.  A proposal indicates that the study’s total cost is $50,000.  TMACOG is contributing $20,000.  This ordinance authorizes the expenditure of $30,000 from the Division of Transportation general fund budget, where funds are available to be reappropriated in 2018 for this purpose.  This Ordinance would also authorize the Mayor to enter into agreements with Transportation Economics & Management Systems Inc. to undertake the study and with TMACOG to oversee the study (at no cost to the City).  Finally, this Ordinance would waive the taking of competitive proposals.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That the Mayor is authorized to enter into any necessary agreement with Transportation Economics & Management Systems Inc. for the purpose of undertaking a rail ridership feasibility & cost estimate study subject to the terms and conditions deemed proper and requisite according to the Director of Law, not to exceed $50,000.

 

SECTION 2. That the Mayor is authorized to enter into any necessary agreement with TMACOG. for the purpose of overseeing the above mentioned ridership feasibility & cost estimate study and to accept a $20,000 contribution toward the cost of the study subject to the terms and conditions deemed proper and requisite according to the Director of Law.

 

SECTION 3.  That the finance director is authorized to accept and deposit a contribution from TMACOG in the amount not to exceed $20,000 into General Fund Account Code 1001-22500-5651001STDSTD and that amount is appropriated for the purposes set forth herein.

 

SECTION 4.  That the expenditure of $50,000 is authorized from the General Fund Account Code 1001-22500-5651001STDSTD for Toledo-Detroit Rail Ridership Feasibility & Cost Estimate Study.

 

                     SECTION 5.  That the disappropriation of $30,000 is authorized from the General Fund Account Code 1001-22500-537410-2450018BIKESH and the appropriation of same is authorized to the General Fund Account Code 1001-22500-5651001STDSTD for a Toledo-Detroit Rail Ridership Feasibility & Cost Estimate Study.

 

           SECTION 6.  That the Director of Finance is authorized to issue warrant or warrants against the above account code in an amount not to exceed $50,000 in payment of all obligations authorized upon presentation of properly approved documentation.

 

                     SECTION 7. That the provisions of Toledo Municipal Code Chapter 187 regarding competitive proposals are hereby waived for purposes of entering the agreements authorized herein.

 

                     SECTION 8. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that same must be immediately effective in order to undertake a Toledo-Detroit Rail Ridership Feasibility & Cost Estimate Study.
