SUMMARY & BACKGROUND:
Toledo City Council by Ordinance 147-18 declared a moratorium on the authority of the Toledo-Lucas County Plan Commission to accept applications for Special Use Permits for Residential Drug and Alcohol Treatment Facilities within Council District 4. The purpose of this moratorium was to allow Council to study what adverse impact, if any, the concentration of Residential Drug & Alcohol Treatment Facilities has on neighborhoods in Toledo, particularly with regard to traffic congestion, criminal activity and the maintenance of housing in the vicinity of such facilities. It has been determined that the Plan Commission is in need of additional time to complete that study and present the findings to Council.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That the authority of the Toledo-Lucas County Plan Commission to accept applications for Special Use Permits for Residential Drug & Alcohol Treatment Facilities within Council District 4 is hereby suspended until April 15, 2019.

SECTION 2. That this Ordinance hereby is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason being that a moratorium is necessary to allow time to review Special Use Permit regulations for Residential Drug & Alcohol Treatment Facilities.
